Shouldn’t police do a field of sobriety test first , then ask for you to use a breathalizer?
When I got pulled over they asked me to blow into a tester right away,then asked to do the field of sobriety test, past the field of sobriety test,took me to draw blood and was 2 tenths over the legal limit.
If you were still at the scene of the stop, that was not a Breathalyzer, it was a Preliminary Breath Test (PBT). This is a screening device only, and not admitted into evidence.
Common practice is to do field sobriety first, but there is no law requiring a certain order.
